TITRE I

Dispositions communes

Article A  

Par le présent traité, les HAUTES PARTIES CONTRACTANTES instituent entre Elles une UNION EUROPÉENNE, ci-après dénommée "Union".

TITLE I

Common provisions

Article A 

By this Treaty, the HIGH CONTRACTING PARTIES establish among themselves a EUROPEAN UNION, hereinafter called 'the Union'.

Article B  

L'Union se donne pour objectifs:

Article B 

The Union shall set itself the following objectives:

• de promouvoir un progrès économique et social équilibré et durable, notamment par la création d'un espace sans frontières intérieures, par le renforcement de la cohésion économique et sociale et par l'établissement d'une Union économique et monétaire comportant, à terme, une monnaie unique, conformément aux dispositions du présent traité;

• to promote economic and social progress which is balanced and sustainable, in particular through the creation of an area without internal frontiers, through the strengthening of economic and social cohesion and through the establishment of economic and monetary union, ultimately including a single currency in accordance with the provisions of this Treaty;

• d'affirmer son identité sur la scène internationale, notamment par la mise en oeuvre d'une politique étrangère et de sécurité commune, y compris la définition à terme d'une politique de défense commune, qui pourrait conduire, le moment venu, à une défense commune;

• to assert its identity on the international scene, in particular through the implementation of a common foreign and security policy including the eventual framing of a common defence policy, which might in time lead to a common defence;

• de renforcer la protection des droits et des intérêts des ressortissants de ses États membres par l'instauration d'une citoyenneté de l'Union;

• to strengthen the protection of the rights and interests of the nationals of its Member States through the introduction of a citizenship of the Union;

• de développer une coopération étroite dans le domaine de la justice et des affaires intérieures;

• to develop close cooperation on justice and home affairs;

• de maintenir intégralement l'acquis communautaire et de le développer afin d'examiner, conformément à la procédure visée à l'article N, paragraphe 2, dans quelle mesure les politiques et formes de coopération instaurées par le présent traité devraient être révisées en vue d'assurer l'efficacité des mécanismes et institutions communautaires.

• to maintain in full the acquis communautaire and build on it with a view to considering, through the procedure referred to in Article N(2), to what extent the policies and forms of cooperation introduced by this Treaty may need to be revised with the aim of ensuring the effectiveness of the mechanisms and the institutions of the Community.

Article C  

L'Union dispose d'un cadre institutionnel unique qui assure la cohérence et la continuité des actions menées en vue d'atteindre ses objectifs, tout en respectant et en développant l'acquis communautaire.

Article C 

The Union shall be served by a single institutional framework which shall ensure the consistency and the continuity of the activities carried out in order to attain its objectives while respecting and building upon the acquis communautaire.

Article D  

Le Conseil européen donne à l'Union les impulsions nécessaires à son développement et en définit les orientations politiques générales.

Article D 

The European Council shall provide the Union with the necessary impetus for its development and shall define the general political guidelinesthereof.

Article E  

Le Parlement européen, le Conseil, la Commission et la Cour de justice exercent leurs attributions dans les conditions et aux fins prévues, d'une part, par les dispositions des traités instituant les Communautés européennes et des traités et actes subséquents qui les ont modifiés ou complétés et, d'autre part, par les autres dispositions du présent traité.

Article E 

The European Parliament, the Council, the Commission and the Court of Justice shall exercise their powers under the conditions and for the purposes provided for, on the one hand, by the provisions of the Treaties establishing the European Communities and of the subsequent Treaties and Acts modifying and supplementing them and, on the other hand, by the other provisions of this Treaty.

Article F  

1. L'Union respecte l'identité nationale de ses États membres, dont les systèmes de gouvernement sont fondés sur les principes démocratiques.

Article F 

1. The Union shall respect the national identities of its Member States, whose systems of government are founded on the principles of democracy.

Article J  

Il est institué une politique étrangère et de sécurité commune, régie par les dispositions suivantes.

TITLE V

Provisions on a common foreign and security policy

Article J

A common foreign and security policy is hereby established which shall be governed by the following provisions.

Article J.1  

1. L'Union et ses États membres définissent et mettent en oeuvre une politique étrangère et de sécurité commune, régie par les dispositions du présent titre et couvrant tous les domaines de la politique étrangère et de sécurité.

Article J.1  

1. The Union and its Member States shall define and implement a common foreign and security policy, governed by the provisions of this Title and covering all areas of foreign and security policy.

• la sauvegarde des valeurs communes, des intérêts fondamentaux et de l'indépendance de l'Union;
• le renforcement de la sécurité de l'Union et de ses États membres sous toutes ses formes;
• le maintien de la paix et le renforcement de la sécurité internationale, conformément aux principes de la Charte des Nations unies, ainsi qu'aux principes de l'Acte final de Helsinki et aux objectifs de la Charte de Paris;
• la promotion de la coopération internationale;
• le développement et le renforcement de la démocratie et de l'État de droit, ainsi que le respect des droits de l'homme et des libertés fondamentales.

• to safeguard the common values, fundamental interests and independence of the Union;
• to strengthen the security of the Union and its Member States in all ways;
• to preserve peace and strengthen international security, in accordance with the principles of the United Nations Charter as well as the principles of the Helsinki Final Act and the objectives of the Paris Charter;
• to promote international cooperation;
• to develop and consolidate democracy and the rule of law, and respect for human rights and fundamental freedoms.

• en instaurant une coopération systématique entre les États membres pour la conduite de leur politique, conformément à l'article J.2;
• en mettant graduellement en oeuvre, conformément à l'article J.3, des actions communes dans les domaines où les États membres ont des intérêts importants en commun.

• by establishing systematic cooperation between Member States in the conduct of policy, in accordance with Article J.2;
  
• by gradually implementing, in accordance with Article J.3, joint action in the areas in which the Member States have important interests in common.

Article J.2  

1. Les États membres s'informent mutuellement et se concertent au sein du Conseil sur toute question de politique étrangère et de sécurité présentant un intérêt général, en vue d'assurer que leur influence combinée s'exerce de la manière la plus efficace par la convergence de leurs actions.

Article J.2  

1. Member States shall inform and consult one another within the Council on any matter of foreign and security policy of general interest in order to ensure that their combined influence is exerted as effectively as possible by means of concerted and convergent action.

Les États membres veillent à la conformité de leurs politiques nationales avec les positions communes.

Member States shall ensure that their national policies conform to the common positions.

Au sein des organisations internationales et lors des conférences internationales auxquelles tous les États membres ne participent pas, ceux qui y participent défendent les positions communes.

In international organizations and at international conferences where not all the Member States participate, those which do take part shall uphold the common positions.

Article J.3  

La procédure pour adopter une action commune dans les domaines relevant de la politique étrangère et de sécurité est la suivante:

The procedure for adopting joint action in matters covered by the foreign and security policy shall be the following:

1. le Conseil décide, sur la base d'orientations générales du Conseil européen, qu'une question fera l'objet d'une action commune.

Lorsque le Conseil arrête le principe d'une action commune, il en fixe la portée précise, les objectifs généraux et particuliers que s'assigne l'Union dans la poursuite de cette action, ainsi que les moyens, procédures, conditions et, si nécessaire, la durée applicables à sa mise en oeuvre;

1. The Council shall decide, on the basis of general guidelines from the European Council, that a matter should be the subject of joint action.

Whenever the Council decides on the principle of joint action, it shall lay down the specific scope, the Union's general and specific objectives in carrying out such action, if necessary its duration, and the means, procedures and conditions for its implementation.

2. lors de l'adoption de l'action commune et à tout stade de son déroulement, le Conseil définit les questions au sujet desquelles des décisions doivent être prises à la majorité qualifiée.

Pour les délibérations du Conseil qui requièrent la majorité qualifiée conformément au premier alinéa, les voix des membres sont affectées de la pondération visée à l'article 148, paragraphe 2, du traité instituant la Communauté européenne et les délibérations sont acquises si elles ont recueilli au moins soixante-deux voix exprimant le vote favorable d'au moins dix membres;

2. The Council shall, when adopting the joint action and at any stageduring its development, define those matters on which decisions are to be taken by a qualified majority.

Where the Council is required to act by a qualified majority pursuant to the preceding subparagraph, the votes of its members shall be weighted in accordance with Article 148(2) of the Treaty establishing the European Community, and for their adoption, acts of the Council shall require at least 62 votes in favour, cast by at least 10 members.

3. s'il se produit un changement de circonstances ayant une nette incidence sur une question faisant l'objet d'une action commune, le Conseil révise les principes et les objectifs de cette action et adopte les décisions nécessaires. Aussi longtemps que le Conseil n'a pas statué, l'action commune est maintenue;

3. If there is a change in circumstances having a substantial effect on a question subject to joint action, the Council shall review the principles and objectives of that action and take the necessary decisions. As long as the Council has not acted, the joint action shall stand.

4. les actions communes engagent les États membres dans leurs prises de position et dans la conduite de leur action;

4. Joint actions shall commit the Member States in the positions they adopt and in the conduct of their activity.

5. toute prise de position ou toute action nationale envisagée en application d'une action commune fait l'objet d'une information dans des délais permettant, si nécessaire, une concertation préalable au sein du Conseil. L'obligation d'information préalable ne s'applique pas aux mesures qui constituent une simple transposition sur le plan national des décisions du Conseil;

5. Whenever there is any plan to adopt a national position or take national action pursuant to a joint action, information shall be provided in time to allow, if necessary, for prior consultations within the Council. The obligation to provide prior information shall not apply to measures which are merely a national transposition of Council decisions.

6. en cas de nécessité impérieuse liée à l'évolution de la situation et à défaut d'une décision du Conseil, les États membres peuvent prendre d'urgence les mesures qui s'imposent, en tenant compte des objectifs généraux de l'action commune. L'État membre qui prend de telles mesures en informe immédiatement le Conseil;

6. In cases of imperative need arising from changes in the situation and failing a Council decision, Member States may take the necessary measures as a matter of urgency having regard to the general objectives of the joint action. The Member State concerned shall inform the Council immediately of any such measures.

7. en cas de difficultés majeures pour appliquer une action commune, un État membre saisit le Conseil, qui en délibère et recherche les solutions appropriées. Celles-ci ne peuvent aller à l'encontre des objectifs de l'action ni nuire à son efficacité.

7. Should there be any major difficulties in implementing a joint action, a Member State shall refer them to the Council which shall discuss them and seek appropriate solutions. Such solutions shall not run counter to the objectives of the joint action or impair its effectiveness.

Article J.4  

1. La politique étrangère et de sécurité commune inclut l'ensemble des questions relatives à la sécurité de l'Union européenne, y compris la définition à terme d'une politique de défense commune, qui pourrait conduire, le moment venu, à une défense commune.

Article J.4  

1. The common foreign and security policy shall include all questions related to the security of the Union, including the eventual framing of a common defence policy, which might in time lead to a common defence.

Article J.5  

1. La présidence représente l'Union pour les matières relevant de la politique étrangère et de sécurité commune.

Article J.5  

1. The Presidency shall represent the Union in matters coming within the common foreign and security policy.

Article J.6  

Les missions diplomatiques et consulaires des États membres et les délégations de la Commission dans les pays tiers et les conférences internationales, ainsi que leurs représentations auprès des organisations internationales, se concertent pour assurer le respect et la mise en oeuvre des positions communes et des actions communes arrêtées par le Conseil.

Article J.6  

The diplomatic and consular missions of the Member States and the Commission Delegations in third countries and international conferences, and their representations to international organizations, shall cooperate in ensuring that the common positions and common measures adopted by the Council are complied with and implemented.

Article J.7  

La présidence consulte le Parlement européen sur les principaux aspects et les choix fondamentaux de la politique étrangère et de sécurité commune et veille à ce que les vues du Parlement européen soient dûment prises en considération. Le Parlement européen est tenu régulièrement informé par la présidence et la Commission de l'évolution de la politique étrangère et de sécurité de l'Union.

Article J.7  

The Presidency shall consult the European Parliament on the main aspects and the basic choices of the common foreign and security policy and shall ensure that the views of the European Parliament are duly taken into consideration. The European Parliament shall be kept regularly informed by the Presidency and the Commission of the development of the Union's foreign and security policy.

Article J.8  

1. Le Conseil européen définit les principes et les orientations générales de la politique étrangère et de sécurité commune.

Article J.8  

1. The European Council shall define the principles of and general guidelines for the common foreign and security policy.

Article J.9  

La Commission est pleinement associée aux travaux dans le domaine de la politique étrangère et de sécurité commune.

Article J.9  

The Commission shall be fully associated with the work carried out in the common foreign and security policy field.

Article J.10  

Lors d'une révision éventuelle des dispositions relatives à la sécurité conformément à l'article J.4, la conférence qui est convoquée à cet effet examine également si d'autres amendements doivent être apportés aux dispositions relatives à la politique étrangère et de sécurité commune.

Article J.10  

On the occasion of any review of the security provisions under Article J.4,the Conference which is convened to that effect shall also examine whether any other amendments need to be made to provisions relating to the common foreign and security policy.

Article J.11  

1. Les dispositions visées aux articles 137, 138, 139 à 142, 146, 147, 150 à 153, 157 à 163 et 217 du traité instituant la Communauté européenne sont applicables aux dispositions relatives aux domaines visés au présent titre.

Article J.11  

1. The provisions referred to in Articles 137, 138, 139 to 142, 146, 147, 150 to 153, 157 to 163 and 217 of the Treaty establishing the European Community shall apply to the provisions relating to the areas referred to in this Title.

• soit décider à l'unanimité que les dépenses opérationnelles entraînées par la mise en oeuvre desdites dispositions sont mises à la charge du budget des Communautés européennes; dans ce cas, la procédure budgétaire prévue au traité instituant la Communauté européenne s'applique;
• soit constater que de telles dépenses sont à la charge des États membres, éventuellement selon une clef de répartition à déterminer.

• either decide unanimously that operational expenditure to which the implementation of those provisions gives rise is to be charged to the budget of the European Communities; in that event, the budgetary procedure laid down in the Treaty establishing the European Community shall be applicable;
• or determine that such expenditure shall be charged to the Member States, where appropriate in accordance with a scale to be decided.

TITRE VI

Dispositions sur la coopération dans les domaines de la justice et des affaires intérieures

Article K

La coopération dans les domaines de la justice et des affaires intérieures est régie par les dispositions suivantes.

TITLE VI

Provisions on cooperation in the fields of justice and home affairs

Article K

Cooperation in the fields of justice and home affairs shall be governed by the following provisions.

Article K.1

Aux fins de la réalisation des objectifs de l'Union, notamment de la libre circulation des personnes, et sans préjudice des compétences de la Communauté européenne, les États membres considèrent les domaines suivants comme des questions d'intérêt commun:

Article K.1  

For the purposes of achieving the objectives of the Union, in particular the free movement of persons,and without prejudice to the powers of the European Community, Member States shall regard the following areas as matters of common interest:

1. la politique d'asile;

1. asylum policy;

2. les règles régissant le franchissement des frontières extérieures des États membres par des personnes et l'exercice du contrle de ce franchissement;

2. rules governing the crossing by persons of the external borders of the Member States and the exercise of controls thereon;

3. la politique d'immigration et la politique à l'égard des ressortissants des pays tiers:
1. les conditions d'entrée et circulation des ressortissants des pays tiers sur le territoire des États membres;
2. les conditions de séjour des ressortissants des pays tiers sur le territoire des États membres, y compris le regroupement familial et l'accès à l'emploi;
3. la lutte contre l'immigration, le séjour et le travail irréguliers de ressortissants des pays tiers sur le territoire des États membres;

3. immigration policy and policy regarding nationals of third countries:
1. conditions of entry and movement by nationals of third countries on the territory of Member States;
2. conditions of residence by nationals of third countries on the territory of Member States, including family reunion and access to employment;
3. combating unauthorized immigration, residence and work by nationals of third countries on the territory of Member States;

4. la lutte contre la toxicomanie dans la mesure où ce domaine n'est pas couvert par les points 7), 8) et 9);

4. combating drug addiction in so far as this is not covered by (7) to (9);

5. la lutte contre la fraude de dimension internationale dans la mesure où ce domaine n'est pas couvert par les points 7), 8) et 9);

5. combating fraud on an international scale in so far as this is not covered by (7) to (9);

6. la coopération judiciaire en matière civile;

6. judicial cooperation in civil matters;

7. la coopération judiciaire en matière pénale;

7. judicial cooperation in criminal matters;

8. la coopération douanière;

8. customs cooperation;

9. la coopération policière en vue de la prévention et de la lutte contre le terrorisme, le trafic illicite de drogue et d'autres formes graves de criminalité internationale, y compris, si nécessaire, certains aspects de coopération douanière, en liaison avec l'organisation à l'échelle de l'Union d'un système d'échanges d'informations au sein d'un Office européen de police (Europol).

9. police cooperation for the purposes of preventing and combating terrorism, unlawful drug-trafficking and other serious forms of international crime, including if necessary certain aspùects of customs cooperation, in connection with the organization of a Union-wide system for exchanging information within a European Police Office (Europol).

Article K.2

1. Les questions visées à l'article K.1 sont traitées dans le respect de la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales, du 4 novembre 1950, et de la Convention relative au statut des réfugiés, du 28 juillet 1951, et en tenant compte de la protection accordée par les États membres aux personnes persécutées pour des motifs politiques.

Article K.2  

1. The matters referred to in Article K.1 shall be dealt with in compliance with the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 and the Convention relating to the Status of Refugees of 28 July 1951 and having regard to the protection afforded by Member States to persons persecuted on political grounds.

Article K.3

1. Dans les domaines visés à l'article K.1, les États membres s'informent et se consultent mutuellement au sein du Conseil, en vue de coordonner leur action. Ils instituent à cet effet une collaboration entre les services compétents de leurs administrations.

Article K.3  

1. In the areas referred to in Article K.1, Member States shall inform and consult one another within the Council with a view to coordinating their action. To that end, they shall establish collaboration between the relevant departments of their administrations.

• à l'initiative de tout État membre ou de la Commission dans les domaines visés aux points 1) à 6) de l'article K.1,

• on the initiative of any Member State or of the Commission, in the areas referred to in Article K.1(1) to (6);

• à l'initiative de tout État membre dans les domaines visés aux points 7), 8) et 9) de l'article K.1:
1. arrêter des positions communes et promouvoir, sous la forme et selon les procédures appropriées, toute coopération utile à la poursuite des objectifs de l'Union;
2. adopter des actions communes, dans la mesure où les objectifs de l'Union peuvent être mieux réalisés par une action commune que par les États membres agissant isolément, en raison des dimensions ou des effets de l'action envisagée; il peut décider que les mesures d'application d'une action commune seront adoptées à la majorité qualifiée;
3. sans préjudice de l'article 220 du traité instituant la Communauté européenne, établir des conventions dont il recommandera l'adoption par les États membres selon leurs règles constitutionnelles respectives.

Sauf dispositions contraires prévues par ces conventions, les éventuelles mesures d'application de celles-ci sont adoptées au sein du Conseil, à la majorité des deux tiers des Hautes Parties Contractantes.

• on the initiative of any Member State, in the areas referred to in Article K.1(7) to (9):
  
  
1. adopt joint positions and promote, using the appropriate form and procedures, any cooperation contributing to the pursuit of the objectives of the Union;
   
   
2. adopt joint action in so far as the objectives of the Union can be attained better by joint action than by the Member States acting individually on account of the scale or effects of the action envisaged; it may decide that measures implementing joint action are to be adopted by a qualified majority;
   
   
   
3. without prejudice to Article 220 of the Treaty establishing the European Community, draw up conventions which it shall recommend to the Member States for adoption in accordance with their respective constitutional requirements.

Unless otherwise provided by such conventions, measures implementing them shall be adopted wihtin the Council by a majority of two thirds of the High Contracting Parties.

Ces conventions peuvent prévoir que la Cour de justice est compétente pour interpréter leurs dispositions et pour statuer sur tout différend concernant leur application, selon les modalités qu'elles peuvent préciser.

Such conventions may stipulate that the Court of Justice shall have jurisdiction to interpret their provisions and to rule on any disputes regarding their application, in accordance with such arrangements as they may lay down.

Article K.4

1. Il est institué un comité de coordination composé de hauts fonctionnaires. En plus de son rle de coordination, ce comité a pour mission:

Article K.4  

1. A Coordinating Committee shall be set up consisting of senior officials. In addition to its coordinating role, it shall be the task of the Committee to:

• de formuler des avis à l'intention du Conseil, soit à la requête de celui-ci, soit de sa propre initiative;

• give opinions for the attention of the Council, either at the Council's request or on its own initiative;

• de contribuer, sans préjudice de l'article 151 du traité instituant la Communauté européenne, à la préparation des travaux du Conseil dans les domaines visés à l'article K.1, ainsi que, selon les conditions prévues à l'article 100 D du traité instituant la Communauté européenne, dans les domaines visés à l'article 100 C dudit traité.

• contribute, without prejudice to Article 151 of the Treaty establishing the European Community, to the preparation of the Council's discussions in the areas referred to in Article K.1 and, in accordance with the conditions laid down in Article 100d of the Treaty establishing the European Community, in the areas referred to in Article 100c of that Treaty.

Article K.5

Les États membres expriment les positions communes arrêtées conformément au présent titre dans les organisations internationales et lors des conférences internationales auxquelles ils participent.

Article K.5  

Within international organizations and at international conferences in which they take part, Member States shall defend the common positions adopted under the provisions of this Title.

Article K.6

La présidence et la Commission informent régulièrement le Parlement européen des travaux menés dans les domaines relevant du présent titre.

Article K.6  

The Presidency and the Commission shall regularly inform the European Parliament of discussions in the areas covered by this Title.

Article K.7

Les dispositions du présent titre ne font pas obstacle à l'institution ou au développement d'une coopération plus étroite entre deux ou plusieurs États membres, dans la mesure où cette coopération ne contrevient ni n'entrave celle qui est prévue au présent titre.

Article K.7  

The provisions of this Title shall not prevent the establishment or development of closer cooperation between two or more Member States in so far as such cooperation does not conflict with, or impede, that provided for in this Title.

Article K.8

1. Les dispositions visées aux articles 137, 138, 139 à 142, 146, 147, 150 à 153, 157 à 163 et 217 du traité instituant la Communauté européenne sont applicables aux dispositions relatives aux domaines visés au présent titre.

1. The provisions referred to in Articles 137, 138, 139 to 142, 146, 147, 150 to 153, 157 to 163 and 217 of the Treaty establishing the European Community shall apply to the provisions relating to the areas referred to in this Title.

• soit décider à l'unanimité que les dépenses opérationnelles entraînées par la mise en oeuvre desdites dispositions sont à la charge du budget des Communautés européennes; dans ce cas, la procédure budgétaire prévue au traité instituant la Communauté européenne s'applique;

• either decide unanimously that operational expenditure to which the implementation of those provisions gives rise is to be charged to the budget of the European Communities; in that event, the budgetary procedure laid down in the Treaty establishing the European Community shall be applicable;

• soit constater que de telles dépenses sont à la charge des États membres, éventuellement selon une clef de répartition à déterminer.

• or determine that such expenditure shall be charged to the Member States, where appropriate in accordance with a scale to be decided.

Article K.9

Le Conseil, statuant à l'unanimité à l'initiative de la Commission ou d'un État membre, peut décider de rendre applicable l'article 100 C du traité instituant la Communauté européenne à des actions relevant de domaines visés à l'article K.1, points 1) à 6), en déterminant les conditions de vote qui s'y rattachent. Il recommande l'adoption de cette décision par les États membres conformément à leurs règles constitutionnelles respectives.

Article K.9  

The Council, acting unanimously on the initiative of the Commission or a Member State, may decide to apply Article 100c of the Treaty establishing the European Community to action in areas referred to in Article K.1(1) to (6), and at the same time determine the relevant voting conditions relating to it. It shall recommend the Member States to adopt that decision in accordance with their respective constitutional requirements.

Dispositions finales

Article L 

Les dispositions du traité instituant la Communauté européenne, du traité instituant la Communauté européenne du charbon et de l'acier, du traité instituant la Communauté européenne de l'énergie atomique qui sont relatives à la compétence de la Cour de justice des Communautés européennes et à l'exercice de cette compétence ne sont applicables qu'aux dispositions suivantes du présent traité:

1. les dispositions portant modification du traité instituant la Communauté économique européenne en vue d'établir la Communauté européenne, du traité instituant la Communauté européenne du charbon et de l'acier et du traité instituant la Communauté européenne de l'énergie atomique;

Final provisions

Article L 

The provisions of the Treaty establishing the European Community, the Treaty establishing the European Coal and Steel Community and the Treaty establishing the European Atomic Energy Community concerning the powers of the Court of Justice of the European Communities and the exercise of those powers shall apply only to the following provisions of this Treaty:

1. provisions amending the Treaty establishing the European Economic Community with a view to establishing the European Community, the Treaty establishing the European Coal and Steel Community and the Treaty establishing the European Atomic Energy Community;

Article M

Article M 

Subject to the provisions amending the Treaty establishing the European Economic Community with a view to establishing the European Community, the Treaty establishing the European Coal and Steel Community and the Treaty establishing the European Atomic Energy Community, and to these final provisions, nothing in this Treaty shall affect the Treaties establishing the European Communities or the subsequent Treaties and Acts modifying or supplementing them.

1. Le gouvernement de tout État membre, ou la Commission, peut soumettre au Conseil des projets tendant à la révision des traités sur lesquels est fondée l'Union.

1. The government of any Member State or the Commission may submit to the Council proposals for the amendment of the Treaties on which the Union is founded.

Any European State may apply to become a member of the Union. It shall address its application to the Council, which shall act unanimously after consulting the Commission and after receiving the assent of the European Parliament, which shall act by an absolute majority of its component members.

1. Sont abrogés les articles 2 à 7 et 10 à 19 du traité instituant un Conseil unique et une Commission unique des Communautés européennes, signé à Bruxelles le 8 avril 1965.

1. Le présent traité sera ratifié par les Hautes Parties Contractantes, conformément à leurs règles constitutionnelles respectives. Les instruments de ratification seront déposés auprès du gouvernement de la République italienne.

1. This Treaty shall be ratified by the High Contracting Parties in accordance with their respective constitutional requirements. The instruments of ratification shall be deposited with the Government of the Italian Republic.

Article S 

Le présent traité rédigé en un exemplaire unique, en langues allemande, anglaise, danoise, espagnole, française, grecque, irlandaise, italienne, néerlandaise et portugaise, les textes établis dans chacune de ces langues faisant également foi, sera déposé dans les archives du gouvernement de la République italienne, qui remettra une copie certifiée conforme à chacun des gouvernements des autres États signataires.

Article S 

This Treaty, drawn up in a single original in the Danish, Dutch, English, French, German, Greek, Irish, Italian, Portuguese and Spanish languages, the texts in each of these languages being equally authentic, shall be deposited in the archives of the government of the Italian Republic, which will transmit a certified copy to each of the governments of the other signatory States.
